Terms of Service

1. Acceptance of Terms

By accessing or using FinanceBroker.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FinanceBroker.ai provides an AI-powered call answering and management platform for finance and mortgage brokers. The Service includes inbound call handling, outbound calling campaigns, call recording and transcription, and related notification and reporting features.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorised use of your account
  • You must be at least 18 years old to use the Service

4. Subscription and Billing

  • Monthly subscription fees are charged in advance
  • Call usage is billed in arrears at the start of the following month
  • Calls are measured in 2-minute increments; each increment counts as one call credit
  • Included call credits reset monthly and do not roll over
  • All prices are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise
  • Payments are processed securely via Stripe

5. No Lock-In Contracts

There are no lock-in contracts, minimum terms, or break costs. You may cancel your subscription at any time. Upon cancellation, your service will remain active until the end of your current billing period.

6. Foundation Pricing

Foundation pricing locks in your current rates for 12 months from the date of sign-up. You are free to change plans during this period at the same foundation rates.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Use the outbound calling feature for unsolicited cold calling without appropriate consent
  • Attempt to interfere with or disrupt the Service
  • Resell or redistribute the Service without our written permission
  • Upload malicious content or data

8. Call Recording and Compliance

The Service records calls and provides transcripts. It is your responsibility to ensure that call recording complies with applicable laws in your state or territory. The AI assistant provides upfront disclosure to callers that the call may be recorded.

9. Data Ownership

  • You retain ownership of all data generated through your use of the Service, including call recordings, transcripts, and summaries
  • We do not claim ownership of your data
  • We may use anonymised, aggregated data to improve the Service

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will provide reasonable notice of planned maintenance where possible.

11. Limitation of Liability

To the maximum extent permitted by Australian law, FinanceBroker.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless FinanceBroker.ai from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

13. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be subject to the jurisdiction of the Australian courts.
